Terms and Conditions for BeYourCover

These Terms and Conditions govern your access to and use of BeYourCover, including our website, apps, dashboards, APIs, enterprise features, and related services. By accessing or using the service, you agree to these Terms.

If you use the service on behalf of a company, publisher, agency, or other organization, you represent that you have authority to bind that organization to these Terms.

BeYourCover provides AI-assisted tools for creating and managing book-cover assets. Depending on your plan and the features you use, the service may include ebook cover generation, prompt adaptation, image editing and restyling, variations, text removal, audiobook cover creation, upscaling, wrap-cover creation, full-wrap PDF export, and enterprise or API access.

We may add, remove, suspend, or modify features at any time, including beta or experimental features, in order to improve the service, address abuse, or comply with legal or provider requirements.

You must provide accurate account information and keep your login credentials, magic-link access, OAuth access, and any API keys secure. You are responsible for activity that occurs under your account or API credentials.

You must promptly notify us if you believe your account or API key has been compromised. We may suspend or rotate credentials when we reasonably believe doing so is necessary to protect users, the platform, or third-party providers.

You retain whatever rights you have in the text, prompts, images, book metadata, and other materials you submit to the service. You are responsible for those materials and for ensuring you have all rights, permissions, consents, and licenses needed to submit them and ask us to process them.

By using the service, you grant us and our subprocessors a non-exclusive, worldwide, limited license to host, copy, transmit, store, transform, analyze, and otherwise process your submitted materials as needed to operate, secure, improve, and provide the service to you.

Subject to your compliance with these Terms, you may use outputs you generate through the service for lawful personal or commercial purposes to the extent permitted by applicable law and the terms of any third-party providers involved in producing those outputs.

BeYourCover does not guarantee that any output is exclusive, unique, copyrightable, non-infringing, merchantable, fit for a particular purpose, or available for unrestricted resale, licensing, or trademark use. AI-generated content can resemble existing works, contain factual or visual errors, or create inaccurate impressions.

You are solely responsible for reviewing outputs before use, including for rights clearance, brand safety, title and subtitle accuracy, market suitability, and compliance with retailer, printer, or advertising rules.

Wrap covers and exported PDFs are generated from your selected trim size, page count, paper settings, uploaded assets, and other inputs. Spine width, bleed, barcode zones, color behavior, and final print results can vary based on the final interior file and the printer you use.

We do not guarantee that any wrap export, PDF, or print file will satisfy Amazon KDP, IngramSpark, Audible, or any other marketplace or printer requirement without your own proofing, validation, and final approval.

Certain features require payment, a subscription, credits, or both. Consumer plans may include one-time image or download credits, while enterprise plans may include recurring monthly credits, API usage limits, and separately purchased overage credits.

Credits may be deducted when you generate, vary, edit, upscale, export, or otherwise use paid features. Subscription allocations, renewal behavior, and overage pricing are described in the product at checkout or in your dashboard and may change prospectively.

Except where required by law or expressly stated by us in writing at checkout, payments are non-refundable and non-cancelable once the applicable credits, subscription access, or digital services have been provisioned.

If you use enterprise features or the API, you must keep API keys confidential, implement reasonable safeguards in your own products, and ensure your downstream use complies with these Terms, applicable law, and the policies of any marketplaces or printers you target.

You may not represent AI-generated or exported assets as reviewed, approved, guaranteed, or exclusively owned by us. If you redistribute outputs to your customers or end users, you remain responsible for the claims you make about those outputs.

You may not use the service to violate law, infringe intellectual property or privacy rights, generate or distribute unlawful or harmful content, evade safety controls, scrape or reverse engineer the service except where prohibited by law, or interfere with the operation or security of the platform.

You may not use the service in a way that violates the terms of our payment providers, AI providers, storage providers, or infrastructure partners.

We may suspend, restrict, or terminate access to the service if you violate these Terms, create risk for us or other users, fail to pay applicable fees, or if we are required to do so by law or by a third-party provider.

You may stop using the service at any time. Sections that by their nature should survive termination, including payment obligations, disclaimers, limitations of liability, indemnity, and dispute-related provisions, will survive.

The service relies on third-party providers for authentication, billing, AI processing, storage, analytics, email delivery, and infrastructure. Your use of certain features may therefore also be subject to third-party terms and technical limitations.

We are not responsible for outages, feature removals, content restrictions, policy changes, or errors caused by third-party providers.

The service is provided on an "as is" and "as available" basis to the fullest extent permitted by law. BeYourCover disclaims all warranties, whether express, implied, statutory, or otherwise, including implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, quiet enjoyment, and uninterrupted availability.

We do not warrant that the service or any output will be error-free, secure, always available, accepted by any retailer or printer, or free from content issues, policy flags, or legal claims.

To the fullest extent permitted by law, BeYourCover and its affiliates, officers, employees, contractors, and licensors will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, goodwill, data, business opportunities, or replacement costs arising out of or related to the service.

To the fullest extent permitted by law, our aggregate liability for claims arising out of or relating to the service will not exceed the greater of the amounts you paid to BeYourCover for the service in the 12 months before the event giving rise to the claim, or one hundred U.S. dollars (USD 100).

You will defend, indemnify, and hold harmless BeYourCover and its affiliates, officers, employees, contractors, and licensors from and against claims, damages, liabilities, losses, costs, and expenses, including reasonable legal fees, arising out of or related to your submitted materials, your outputs, your use of the service, your downstream distribution of outputs, or your violation of these Terms or applicable law.

These Terms are governed by the laws of Spain, without regard to conflict-of-law principles. Unless applicable law requires otherwise, the courts located in Spain will have exclusive jurisdiction over disputes arising out of or relating to these Terms or the service.

We may update these Terms from time to time. When we do, we will post the revised version on this page and update the last-updated date above. Material changes may also be communicated through the service or by email where appropriate.

Your continued use of the service after updated Terms become effective means you accept the revised Terms.
